Arizona Rules of Professional Conduct

If you are intending to do any internet advertising in Arizona, you will need to look through the Arizona Rules of Professional Conduct.

You will need to have some sort of contact information on your advertisement (such as an Attorney or firm name) to ensure your business is accountable for any information presented, according to Arizona Bar rules.

If you fail to follow the guidelines, the Arizona Bar may need to take some sort of disciplinary action; that’s why it’s so important to have an experienced law firm marketing team to make sure your website and advertisements are up to those standards.

Key Rule to be Aware of

ER 7.1.     Communications Concerning a Lawyer’s Services

A lawyer shall not make a false or misleading communication about the lawyer or the lawyer’s services.
(a) A communication is false or misleading if it contains a material misrepresentation of fact or law, or omits a fact necessary to make the statement considered as a whole not materially misleading.
(b) A lawyer shall not state or imply that a lawyer is certified as a specialist in a particular field of law, unless the lawyer complies with Arizona Supreme Court Rule 44 requirements.
(c) Any communication made pursuant to this Rule shall include the name and contact information for at least one lawyer or law firm responsible for its content.
In 2019, there was an amendment to this rule, as misleading truthful statements are also prohibited.
